The notion of « good faith »

Article written by Martin Monestier, withn its autorisation: Inernational Yearbook of stolen works of Art. This notion of « good faith » is sytematically put forward by most persons implicated in a concealment case . The concealment of stolen goods has often been considered an offence related to theft. In fact, the real curse is not the burglar but the concealer or receiver; for the concealment of stolen goods is not, as many imagine, a consequence of theft: it is rather the true incentive, the major cause. Let us note that, in criminal networks, it is the concealers who set the trends in the illicit market and order particular thefts

At one of the antiquarian biennal in Paris, an exhibitor was selling a « Boulle » writing desk which had been stolen from its legal owner twelve years previously. The investigation traced the desk back trough a mill of sources: an antique dealer in Nice and another legitimate in Florence, who himself had received the desk from a second-hand dealer in Turin.

In this case, as in dozens of others, the antique dealer, the last owner of the stolen piece, was recognized to be of « good faith ». The piece had been entered in his police register, with mention of the name and address of his seller, and the amount of the transaction had been paid by check.

The whole problem of fighting against the concealment and recycling of stolen goods lies in the multiplication of « links », which complicate the task of the Police to a remarkable degree. Under the law, ownership of furniture and objects is legitimate if the purchase is legal and in good faith.

But at the end of the chain buyers of stolen art-objects are unable to define the origin of their acquisition. They may therefore in no way be considered responsible, and the task of the accusing party -to prove bad faith – is usually an impossible mission. This largely explains the incredible fact that 30% of stolen art-objetcs and woks of art are recycled through legal channels of sale.
